Wrongful Death Lawsuit Continues

NEW HANOVER COUNTY -- Tuesday was the second day of testimony in a wrongful death lawsuit.

Robert Hewson shot and killed his estranged wife Gail Tice in September 2004. Now Tice's family and friends are shooting back with a civil lawsuit.

Convicted killer, 72-year-old Robert Hewson admitted he gunned down his estranged wife Gail Tice nearly a year and a half ago at the couple's home in the Landfall community in 2004.

Now Hewson is acting as his own attorney against a wrongful death lawsuit filed by the victim's family. Hewson appeared dazed and belligerent at times during day two of the trial, as half a dozen witnesses -- including one of Tice's sons, Tice's best-friend and several officers -- took the stand Tuesday.

Tice's family says they are owed compensation for Gail Tice's death. They are asking the court to allow more than $10,000 in damages for their pain and suffering, funeral expenses, punitive damages and attorney fees -- all stemming from the murder.

Still Hewson proclaims his love for Gail and his innocence in the case.

The judge gave Hewson the option of taking the stand Tuesday. Hewson turned that offer down. Hewson told the court he did not want his testimony to interfere with his ongoing appeal in his criminal case.
